4. License Grant

Subject to your compliance with these Terms, Noks Development grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services solely for personal, lawful, and non-commercial purposes.

No ownership rights are transferred to you.

(b) modify, adapt, translate, create derivative works, or otherwise alter the Services;
(c) reverse engineer, decompile, disassemble, extract source code from, or otherwise attempt to discover the underlying technology of the Services;
(d) bypass, disable, interfere with, or circumvent any technological protection measures, security systems, licensing systems, or access restrictions;
(e) use the Services to develop, train, benchmark, improve, or provide competing products or services;
(f) scrape, harvest, extract, copy, or collect data from the Services through automated or manual means.

Any unauthorized use shall immediately terminate all rights granted under these Terms.

6. User Accounts

Certain Services may require registration of an account.

You are solely responsible for:

maintaining the confidentiality of your credentials;
all activity occurring under your account;
ensuring the security of your devices and accounts.

You agree to promptly notify us of any suspected unauthorized access or security incident.

Noks Development has no obligation to monitor User Content;
you bear sole responsibility for the legality, accuracy, reliability, and consequences of your User Content.

You represent and warrant that you possess all necessary rights and permissions required to provide such User Content.

8. License to User Content

By providing User Content, you grant Noks Development a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, adapt, and otherwise use such User Content solely as necessary to operate, maintain, improve, secure, and provide the Services.

This license terminates when User Content is permanently deleted, except where retention is reasonably necessary for backup, legal, security, fraud-prevention, or operational purposes.

9. Subscription Services

Certain features of the Services may require payment of subscription fees.

Subscriptions may automatically renew unless cancelled in accordance with the policies of the applicable platform or payment provider.

Subscription prices, plans, benefits, features, and availability may change from time to time.

Changes shall apply prospectively in accordance with applicable law and platform requirements.

Failure to pay applicable fees may result in suspension, restriction, or termination of premium access.

Refund requests are subject to the policies of the applicable payment provider, app store, or platform through which the purchase was made.

10. Acceptable Use

You agree not to:

violate any applicable law;
engage in fraudulent, deceptive, abusive, or unlawful conduct;
impersonate any person or entity;
interfere with the operation of the Services;
access systems without authorization;
introduce malicious software or harmful code;
exploit vulnerabilities;
circumvent security measures;

Noks Development does not control and is not responsible for third-party services.

12. Availability of Services

Noks Development may suspend, interrupt, restrict, or discontinue access to any Service at any time, with or without notice, for maintenance, security, operational, legal, technical, commercial, or other reasons.

We do not guarantee uninterrupted, secure, error-free, or continuous operation.

13. Data Retention and Deletion

We may retain, archive, anonymize, delete, or otherwise process user data in accordance with applicable law, our Privacy Policy, operational requirements, technical limitations, fraud prevention measures, and legitimate business needs.

Upon deletion of an account, some or all associated data may be permanently removed.

Users are solely responsible for maintaining copies of any information they consider important.

Noks Development does not guarantee recovery of deleted data.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS" BASIS.

NOKS DEVELOPMENT DISCLAIMS ALL WARRANTIES, CONDITIONS, REPRESENTATIONS, AND GUARANTEES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, AVAILABILITY, QUALITY, OR PERFORMANCE.

NOKS DEVELOPMENT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOKS DEVELOPMENT, ITS OWNER, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AFFILIATES, AND BUSINESS PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES.

THIS INCLUDES, WITHOUT LIMITATION:

LOSS OF PROFITS;
LOSS OF REVENUE;
LOSS OF DATA;
LOSS OF GOODWILL;
BUSINESS INTERRUPTION;
REPUTATIONAL HARM;
PROCUREMENT OF SUBSTITUTE SERVICES;
PERSONAL DISTRESS;
DIMINUTION IN VALUE.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF NOKS DEVELOPMENT ARISING OUT OF OR RELATED TO THE SERVICES EXCEED THE GREATER OF:

(A) TEN EURO (€10); OR
(B) THE TOTAL AMOUNT PAID BY THE USER TO NOKS DEVELOPMENT DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

16. Indemnification

You agree to defend, indemnify, and hold harmless Noks Development, its owner, contractors, licensors, affiliates, service providers, successors, and assigns from and against any claims, demands, actions, proceedings, liabilities, damages, losses, costs, expenses, penalties, fines, and legal fees arising out of or relating to:

your use of the Services;
your User Content;
your violation of these Terms;
your violation of applicable law;
your infringement of any third-party rights.

17. Suspension and Termination

Noks Development may suspend, restrict, disable, terminate, or permanently remove access to any Service, account, feature, content, subscription, or functionality where reasonably necessary for operational, technical, security, legal, compliance, anti-fraud, abuse-prevention, or business purposes.

Upon termination, all rights granted under these Terms shall immediately cease.

18. Force Majeure

Noks Development shall not be liable for any delay, interruption, failure, or inability to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, governmental actions, war, terrorism, labor disputes, internet failures, cyberattacks, utility interruptions, pandemics, epidemics, or failures of third-party providers.

19. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms constitute the entire agreement between you and Noks Development concerning the Services and supersede all prior agreements, understandings, communications, and representations relating thereto.

Additional Terms for BeautyTracker

These Additional Terms for BeautyTracker ("BeautyTracker Terms") supplement the Noks Development Terms of Service and apply exclusively to users of the BeautyTracker application and related services.

In the event of any conflict between the Noks Development Terms of Service and these BeautyTracker Terms, these BeautyTracker Terms shall prevail solely with respect to BeautyTracker.

22. Artificial Intelligence Features

BeautyTracker may utilize artificial intelligence technologies, machine learning systems, computer vision systems, automated classification systems, language models, image recognition systems, external databases, and other automated technologies to generate, classify, analyze, interpret, summarize, organize, identify, or present information.

Such technologies may be used for purposes including, but not limited to:

product identification;
ingredient analysis;
product classification;
ingredient explanations;
product recommendations;
collection management;
routine management;
challenge tracking;
data organization;
user assistance features.

Users acknowledge and agree that outputs generated by artificial intelligence systems may contain inaccuracies, omissions, outdated information, incomplete results, incorrect classifications, misidentifications, hallucinations, or other errors.

Noks Development makes no representation or warranty regarding the accuracy, completeness, reliability, suitability, scientific validity, regulatory compliance, or usefulness of any AI-generated output.

Any reliance upon AI-generated information is undertaken solely at the user's own risk.

BeautyTracker may provide product identification, barcode matching, image recognition, product search results, or similar functionality.

Certain product information displayed within BeautyTracker may originate from Open Beauty Facts and other open-data projects.

Open Beauty Facts data is provided by contributors and is subject to the rights, licenses, terms, and conditions established by the respective data providers.

BeautyTracker is not affiliated with, endorsed by, sponsored by, or officially associated with Open Beauty Facts unless explicitly stated otherwise.

For attribution purposes:

28. Product Images and Product Information

All trademarks, logos, brand names, trade dress, packaging designs, and intellectual property rights remain the property of their respective owners.
